General sales conditions

Preamble:
The site is the property of SEE MSICA in its totality, as well as the whole of the related rights. All reproductions, integral or partial, are systematically liable to the authorization of the owners. However, the connections of hypertexts type on the site are authorized without specific requests.

1. Protection of the minors:

The minors do not have the capacity to contract and all the data acquisitions must be liable to the agreement of the parental authority which can be opposed to their conservation and/or the transmission with thirds.

2. Acceptance of the conditions:

The customer admits knowing, at the time of the order, the particular conditions of sale announced on this screen and expressly declares accepting them without any reserve.
The present general conditions of sale govern the contractual relations between the SEE MSICA and its customer, the two parts accepting them without any reserve. These general conditions of sale will prevail on all other conditions appearing in any other document, except preliminary derogation, express and written.

3. Products:

The pictures illustrating the products do not enter in the contractual field. If errors were introduced there, the responsibility for SEE MSICA could not be committed. The majority of the products offered to its customers by SEE MSICA are available in stock. But if at any time the ordered products were not in stock we would contact you to cancel or modify your order.

4. Order:

The systems of automatic recording are considered as the proof of the nature, the contents and the date of the order. SEE MSICA confirms the acceptance of its order to the customer with the address mail that has been communicated. The sale will be concluded only as from the confirmation of order. SEE MSICA reserves the right to cancel any order of a customer with whom a dispute would exist relating to the payment of a former order. The information announced by the purchaser, at the time of the order taking engages this one: in case of error in the wording of the details of the recipient, the salesman could not be responsible for the impossibility to deliver the product.

5. Delivery : Metropolitan France and some countries of Western Europe

According to the rules of procedure of the POST OFFICE, in particular the constraints of volume and weight following the ordered quantity, we reserve ourselves the right to proceed to the expedition by a mode of routing in correlation with the ordered quantity, road transport for example.

After confirmation of order, SEE MSICA engages to deliver all the references ordered by the purchaser within a maximum of 5 working days. All the orders placed to SEE MSICA are intended to the personal use of the customers. Any partial or total resale of the products by the customers or the product consignees is prohibited. SEE MSICA is not legally responsible if the payment of the taxes were not carried out by the customer.

Follow-up in Metropolitan France and abroad:

The delivery is carried out in the time crenel of delivery of the mail service carried out by the POST OFFICE or in case of absence, to another person entitled by the customer. The possible delays do not give the right to the purchaser to claim damages.

In the case of apparent defects, the purchaser profits from the right to repossess according to the conditions envisaged in this document. The war, the riot, the fire, the strikes, the accidents and the impossibility of being supplied are regarded as cases of absolute necessity discharging the seller from its obligation to deliver. The goods always travel to the risks and dangers of the recipient. Always check your parcel at the arrival.

In case of missing products or degradation INDICATE THE USUAL RESERVES.

If the customer wishes two places of delivery, in this case two orders must be placed, with the dependent expenses of delivery.

6. Retraction

You have 7 days (from the reception of the articles) to form a wrong idea. In the case of exchange or refunding, return the new article(s) in its (their) packing of origin, intact, accompanied by all the possible accessories, notes of employment and documentations to the following address:

In case of the use of the right of retraction, SEE MSICA is obliged to refund the sums paid by the customer, without expenses, except for the expenses of return. Refunding is carried out within a maximum of 15 days.

7. Price:

The price is expressed including all taxes in Euros.
The price indicated on the product cards does not include transport.
The price indicated in the confirmation of order is the final price, expressed all inclusive of tax and including the VAT for France. This price includes the price of the products, the charges for handling, packing and conservation of the products, the transport and startup charges.

Share in the expenses of sending and treatment:

Sending in France:

Invoicing of products includes all taxes, plus the expenses of sending (followed Colissimo Formula).

8. Payment:

The price invoiced to the customer is the price indicated on the confirmation of order addressed by SEE MSICA.
The price of the products is payable cash the day of the effective order.
The payment is carried out by bank card carrying initials CB.
On line, the CIC Lyonnaise de Banque enables you to pay via a banking waiter of the Lyonnaise de Banque in a protected environment.
Thus, your N° of bank card is directed towards the waiters of the bank, your payment is carried out directly at a bank in an safe environment without passing by the waiter of the shop, all the more important guarantee as your N° is known only of our banking partner (Lyonnaise de Banque).
The order validated by the customer will be considered effective only when the concerned centers of banking payment give their agreement. In case of refusal, the order will be automatically cancelled and the customer warned by electronic mail. In addition, SEE MSICA reserves the right to refuse any ordering of a customer with whom a dispute would exist.

Payment by cheques
The payment of the price of the products by the customer thanks to a cheque is carried out exclusively by cheque made out in Euros on a bank domiciled in Metropolitan France or in Monaco. For a payment by cheque higher than 150 Euros, SEE MSICA requires additional information. Within the framework of this checking, you will be asked for a copy of your identity card. The order will be treated only with reception of this information allowing the identification of the purchaser.

Payment by credit transfer
Only the Companies can pay their purchases by credit transfer.

9. Litigations:

This contract is liable to the French law. SEE MSICA cannot be held responsible for the damage of any nature, as well materials as immaterial or physical, which could result from a faulty operation or misuse of the marketed products. It is the same for the possible modifications of the products by the manufacturers. The responsibility of SEE MSICA will be, in any case, limited to the amount of the order and could not be blamed for simple errors or omissions which could have remained despite all the precautions taken in the presentation of the products. In case of difficulties in the application of this contract, the purchaser has the possibility, before any action at law, to seek a friendly solution in particular with the assistance: of a trade association of the branch, an association of consumers or any other council of his/her choice. One is reminded that the search for the friendly solution does not stop the "short time" of the legal guarantee, nor contractual warranty period. One is reminded that in general and on conditions of the appreciation of the Courts, the respect of the provisions of this contract related to the contractual guarantee supposes that the purchaser honors his financial commitments towards the salesman. The complaints or disputes will be always received with attentive benevolence, the good faith being always supposed concerning everybody who makes the effort to expose its situations. In case of litigation, the customer will contact by priority the company to obtain a friendly solution. With defect, the Commercial court of AVIGNON (84) is only qualified, whatever the place of delivery and the accepted mode of payment.

10. Guarantee:

SEE MSICA guarantees to you that all the selected foodstuffs are manufactured in France and Europe. With regard to food, the dates of consumption indicated must be respected by the customer.
In all the cases SEE MSICA could not be held for person in charge for no-respect for the regulations and legislative into force in the country of reception, the responsibility for SEE MSICA is systematically limited to the value for the blamed product, value at its date of sale and this without possibilities of recourse towards the mark or the producing company of the product. In any assumption, the customer profits from the legal guarantee of ousting and of hidden defects (Art.1625 and following of the civil code). With the condition that the purchaser makes the proof of the hidden defect, the salesman must legally repair all the consequences (art.1641 and following of the civil code).

The defect of information leads to the no-validation of the order. In accordance with the “Data-processing and Freedoms” law, the personal data processing relating to the customers has been declared to the National Commission of Data processing and Freedoms (CNIL) n° 1092287. The customer has (article 34 of the law of January 6, 1978) a right of access, of modification, correction and suppression of the data related to him/her, that he/she can exert at SEE MSICA. Moreover, SEE MSICA is committed not communicating, for free or with counterpart, the details of its customers to a third.
